Demand justice for killing of journalist in Oaxaca, Mexico

On 27 October 2006, US video journalist Brad Will was shot and killed in Oaxaca City, southern Mexico as he filmed a clash between members of a local protest movement (Asamblea Popular del Pueblo de Oaxaca, APPO) and supporters and officials of the local governing party.

Three years later, Amnesty International believes that the truth about Brad Will's death has still not come out. Juan Manuel Martínez, an APPO sympathiser, has been detained pending trial since October 2008 for Will's murder. However, Amnesty International believes the evidence against him is flawed and he is a being used as a scapegoat.

I am writing to express my deep concern about the investigation into the killing of Brad Will in Oaxaca, which led to the detention and prosecution of Juan Manuel Martínez, on the basis of what appears to be flawed evidence.

I am particularly worried about the insistence in concluding that Brad Will was shot at close range, in spite of the fact that forensic experts from Physicians for Human Rights (PHR) and the National Human Rights Commission have demonstrated that this is not based on the scientific evidence available.

I urge you to carry out a thorough and impartial review of the investigation into the death of Brad Will, taking into account all reliable evidence. Juan Manuel Martínez should be released and charges dropped if, as is the case so far, there is insufficient reliable evidence to implicate him.

As a result of the recent Supreme Court of Justice's resolution calling for those responsible for serious human rights violations committed in Oaxaca to be held to account, I call on you to urgently review previously archived investigations into the unlawful killings and other human rights violations which took place during the crisis and for those responsible to be brought to justice.
