Don't Defer Justice in Darfur

The International Criminal Court (ICC) has issued an arrest warrant for Sudanese President Omar al-Bashir on charges of war crimes and crimes against humanity committed in Darfur. Some organizations and United Nations member states are calling for the UN Security Council to suspend the execution of the arrest warrant. The U.S. government has gone on record opposing any compromise on justice. I am writing today to thank you for supporting the International Criminal Court (ICC) in its work on Darfur and to urge you to take action to ensure that the U.N. Security Council does not invoke Article 16 of the Rome Statute to defer any of the cases the ICC is investigating involving the situation in Darfur.

I commend the United States for taking a strong public stand in support of justice for Darfur, and I urge you to remain firm in opposing the use of Article 16. It is critical that the U.S. continue to be a leader on Article 16 and stand out publicly and firmly on this issue as a permanent member of the United Nations Security Council.  Justice should not be used as a bargaining chip. Any deals that would allow those responsible for abuses committed in Darfur to evade accountability will only serve to undermine security in the long-term.  In addition, a deferral would leave the Security Council open to further blackmail by the government of Sudan, which might threaten to renege on the conditions if the ICC were to resume its work on these cases in the future.

I believe that justice can play an important and complementary role in achieving long-term and meaningful peace by establishing an effective deterrent to future crimes and by implementing the rights of victims to justice, truth, and reparations.  Accordingly, I urge you to do everything in your power to ensure that the Security Council does not suspend either the case against President Bashir or the two other cases the ICC is examining in relation to the situation in Darfur.
